Terms of Service AgreementEffective Date: 28th August 2024Welcome to TrainYourWay.AIThese Terms of Service ("Terms") govern your use of the TrainYourWay.AI mobile application ("App"), operated by TrainYourWay.AI ("Company," "we," "us," or "our"). By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the App.1. EligibilityYou must be at least 18 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.2. ServicesTrainYourWay.AI provides a platform for personal trainers to collect necessary data, build workout plans (referred to as "Programs"), and provide feedback on clients' workout performance. Clients can connect their Apple Health or ANY other health data providers account to the App for more personalized workouts.3. User AccountsAccount Registration: To use the App, you must create an account by providing accurate and complete information.Account Security: You are responsible for maintaining the confidentiality of your account credentials and are responsible for all activities that occur under your account.Account Termination: We reserve the right to terminate your account if you upload inappropriate content, send inappropriate, sexual, or violent messages to trainers, or otherwise violate these Terms.4. User ContentContent Upload: Users can upload videos of their workout form to receive feedback from trainers. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, distribute, reproduce, modify, and display your content for the purposes of providing services through the App, as well as training and improving our AI models.Inappropriate Content: Users are prohibited from uploading content that is inappropriate, sexually explicit, violent, or otherwise violates these Terms. Violation of this provision may result in immediate account termination.5. Payment and SubscriptionsTrainer Payments: Clients pay trainers directly for their services. The Company is not responsible for payment disputes between clients and trainers.In-App Purchases: The App may offer additional paid features or services. By making an in-app purchase, you agree to the pricing, payment, and billing policies applicable to such purchases.6. Data Sharing and PrivacyData Sharing: Users can choose to share their data with multiple trainers or gym staff on an opt-in, opt-out basis.Third-Party Integrations: The App integrates with third-party services, including Apple Health, AWS, Datadog, and AI services. By using the App, you agree to the processing and sharing of your data with these services.Exercise Data: Your exercise data is used for analytics, improving AI models, and providing better service to you. This data is processed and stored in accordance with our Privacy Policy.7. Liability and DisclaimersUse at Your Own Risk: The App and its services are provided "as is" and "as available." The Company makes no warranties, either express or implied, regarding the accuracy, reliability, or availability of the App.Limitation of Liability: To the fullest extent permitted by law, the Company shall not be liable for any damages, including but not limited to direct, indirect, incidental, special, consequential, or punitive damages, arising out of or related to your use of the App.8. Governing Law and Dispute ResolutionGoverning Law: These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.Dispute Resolution: Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in San Francisco, California.9. Changes to the TermsWe may update these Terms from time to time. If we make material changes, we will notify you via email. Your continued use of the App after the changes become effective constitutes your acceptance of the new Terms. If you do not agree with the updated Terms, you may terminate your account.10.
