Privacy Policy for Members

Welcome to TrainYourWay.AI (referred to hereinafter as "TrainYourWay" or "we" (including objective "us" and possessive "our")). TrainYourWay provides an AI coaching platform that your gym, studio, or wellness provider (your "Gym") makes available to you as one of its members. Our AI coach, "Jan," helps you plan workouts, track training, sleep and recovery, stay consistent, and keep in touch with your Gym's trainers and staff (the "Platform"). You connect with the Platform through our mobile application for iOS and Android (the "App") and through the TrainYourWay website at https://trainyourway.ai (the "Website"). The Platform, Jan, the App, the Website, and any additional services or materials provided to you are collectively referred to herein as the "Services."

This Privacy Policy explains how we collect, use, share, and protect personally identifiable information ("PII") belonging to you, the member and end user of the Services ("User," or "you," including possessive "your"). PII is information that identifies you or relates to you as an identifiable person, including your name, email address, health and fitness information, the content of your conversations with Jan, and information about the device you use to access the Services.

Gym owners, trainers, clinicians, and staff who use the TrainYourWay Portal are covered by a separate Privacy Notice presented to them in the Portal.

THE SHORT VERSION

This summary is for convenience only. The full Policy below governs.

• Jan creates memories about you from your conversations and activity so coaching stays personal. You can ask Jan what it remembers and ask it to forget things.
• Your Gym's trainers and staff can see your training and coaching data. That is the service.
• We do not sell your personal information, we do not use it for advertising, and we do not share it with third parties for their own purposes. Service providers process it only on our instructions, and our AI model providers do not train on it.
• Tap Delete Account in Settings and we delete all of your data, including Jan's memories about you. You do not need to ask anyone.
• Some features are experimental and labeled as such.

1. PII THAT WE COLLECT BECAUSE YOU PROVIDE IT.

a. Registration. When you create an account we collect your name, email address, date of birth, and, if you choose, a phone number and profile photo. Your Gym may provide some of this to us when it invites you.

b. Intake and Profile. To coach you, Jan asks about your goals, training experience, schedule, available equipment, injuries and physical limitations, and other preferences. You may also enter body measurements such as weight and body composition. You decide what to share; some features work better with more information.

c. Conversations with Jan. We collect the messages you exchange with Jan, including anything you tell Jan about how you feel, what happened in a workout, and why you did or did not train. Jan derives Memories (Section 3.b) from these conversations.

d. Workout and Activity Logs. We collect the workouts you schedule, start, complete, or skip, the exercises, sets, repetitions, weights, and durations you log, and the ratings and notes you add.

e. Photos and Videos. If you choose to upload photos or videos (for example, of your exercise form), we collect them.

f. Communications and Support. We collect information you provide when you communicate with your Gym Staff through the Services or with our customer support team.

2. PII THAT WE COLLECT AUTOMATICALLY.

a. Device and Usage Information. When you use the Services we collect information your device sends to us, such as device model and operating system version, App version, language, time zone, IP address, approximate location derived from your IP address (or precise location only if you enable it), and statistics about how you use the Services, such as which screens you open and when.

b. Health Data from Your Device. If you grant permission, the App reads certain health data from Apple Health (HealthKit) on iOS or Health Connect on Android, including: (i) daily step count, (ii) sleep analysis (duration and sleep stages), (iii) body weight and body-composition measurements, and, where available and enabled, (iv) heart rate and active energy during a workout. This data is used to track your fitness progress, provide personalized coaching, help you and your Gym Staff monitor your activity and recovery, and calculate progress toward your goals. We may also write your completed workout sessions to Apple Health or Health Connect so you can see your training alongside your other activities. Health data is never sold, never used for advertising, and never shared with third parties for their own purposes. You can revoke access at any time in your device settings (on iOS: Settings > Privacy & Security > Health > TrainYourWay; on Android: Health Connect > App permissions > TrainYourWay).

c. Cookies and Similar Technologies. Our Website uses cookies and similar technologies, including Google Analytics, to understand how the Website is used. The App does not use advertising identifiers or third-party advertising cookies.

3. HOW WE USE YOUR PII.

a. Providing the Services. We use your PII to operate the App, authenticate you, generate and adjust your training program, schedule and log workouts, sync with your device's health services, and let your Gym Staff supervise your training.

b. Jan's Memory and Personalization. Jan is an artificial-intelligence coach. To coach you consistently over time, Jan creates and stores memories about you ("Memories"). Memories are short, structured notes derived from your conversations and activity in the following categories: your goals and motivators; your schedule, equipment, and other training constraints; injuries and physical limitations you report; how and when you prefer to be contacted; barriers to consistency and what has helped you overcome them; and rolling summaries of past conversations so Jan does not ask you the same thing twice. Jan also derives coaching inferences from your activity, such as training-consistency patterns and the timing and framing of messages that seem to work for you, and we may test variations of coaching messages to measure and improve their effectiveness. Memories and inferences are stored with your account under a pseudonymous identifier, are used solely to personalize your coaching within the Services and to give your Gym Staff relevant context, are never sold or used for advertising, are never shared with other members or with third parties for their own purposes, and are permanently deleted when your account is deleted. You may ask Jan at any time what it remembers about you and ask it to forget a specific Memory, or contact privacy@trainyourway.ai.

c. AI Processing. Jan and other AI features process your PII, including the content of your conversations, your intake information, your Memories, and your activity data, using large language models operated by our AI model providers. We send these providers only the information needed to generate a response, under contracts that prohibit them from using your information for any purpose other than providing the service to us and from using it to train or improve their models. Safety-critical facts, such as an injury you report, are handled by deterministic rules in addition to AI.

d. Safety. We may use your PII to detect and respond to safety concerns, misuse of the Services, and security incidents.

e. Analytics and Improvement. We use your PII to troubleshoot, test, and improve the Services. Wherever possible we do this with de-identified information: we strip identifying details and aggregate the result so it no longer identifies you ("non-PII"). Aggregated non-PII tells us, for example, how often members use a feature or how message timing affects consistency. We do not use your PII to train third-party AI models.

f. Administrative and Service Communications. We use your PII to send you confirmations, security alerts, support responses, and administrative messages about your account or the Services, and to tell you about new features of the Services you already use. We do not send marketing on behalf of third parties. Where we send optional communications, you can opt out as described in Section 6.

g. No Advertising. We do not use your PII to serve or target advertising, and we do not combine your PII with information from other sources for advertising purposes.

h. Retention. We retain your PII for as long as your account is active. When you delete your account, we delete or de-identify your PII as described in Section 5. We may retain limited records for a longer period where required by law (for example, records of your acceptance of our terms) or in encrypted backups that are purged on a rolling schedule.

4. HOW WE SHARE YOUR PII: NO SALE AND NO THIRD-PARTY SHARING.

TrainYourWay does not sell, rent, or trade your PII, and does not share your PII with third parties for their own marketing, advertising, research, or other purposes. We disclose PII only in the following limited ways:

a. Your Gym and Gym Staff. Your Gym's trainers, coaches, clinicians, and authorized staff can view your profile, program, workout logs, health summaries, progress, Jan's coaching, and relevant Memories so they can supervise and support your training. Their access is limited by role and is logged. Your Gym is responsible for how its staff use your information under your membership agreement with your Gym and applicable law.

b. Service Providers. We use a small number of companies to process PII on our behalf and only on our instructions: cloud hosting and storage (Amazon Web Services), AI model providers that generate Jan's responses, in-app chat delivery, push notifications, error and performance monitoring, and, for the Website, analytics. Each is bound by a written contract that limits its use of your PII to providing services to us, prohibits any independent use, and requires appropriate security. Our AI model providers do not use your PII to train their models.

c. With Your Direction. If you ask us to share information with someone, for example by exporting your data or connecting a third-party service, we will do so.

d. Legal Requirements and Protection of Rights. We may disclose PII when required by law, subpoena, court order, or other legal process; to prevent, detect, or investigate fraud, security incidents, or other unlawful activity; to enforce our terms; or to protect the rights, property, or safety of TrainYourWay, our Users, or others.

e. Business Transfers. If TrainYourWay is involved in a merger, acquisition, financing, reorganization, or sale of assets, your PII may be transferred as part of that transaction. Any successor will be bound by this Privacy Policy with respect to your PII, and we will notify you of any change in ownership or in the use of your PII.

f. Aggregated, De-identified Information. We may share aggregated non-PII that cannot reasonably be linked to you, for example the number of workouts completed across a Gym, with your Gym. We do not share aggregated information with any party in a manner that could identify you.

5. DELETING YOUR ACCOUNT AND YOUR DATA.

You are in control of your data. To delete everything, open Settings in the App and tap Delete Account. You do not need to email us, wait for a review, or ask your Gym. If you cannot use the App, email support@trainyourway.ai from the email address on your account and we will do it for you.

When you delete your account, we delete all of your data:

• Jan's Memories about you, Jan's coaching inferences and behavioral profile about you, rolling conversation summaries, and stored transcripts of your conversations with Jan.
• Your health data synced from Apple Health or Health Connect, your intake responses, your body measurements, and your uploaded photos and videos.
• Your name, email address, phone number, date of birth, profile photo, sign-in identifiers, and every other detail that identifies you.
• Your program and your logged workouts as records about you. Anything that remains is irreversibly stripped of identifiers and cannot be linked back to you.
• Your membership records in the Services, all scheduled coaching messages, and your sign-in account (so your email address is free for re-registration).

Deletion runs immediately when you confirm and is permanent; it cannot be undone. The only things we keep are the record that you accepted our terms, which we are required to keep, anonymous aggregate statistics that cannot identify you, and copies in encrypted backups, which are purged on a rolling schedule. Your Gym may separately hold records about you under its own policies; contact your Gym about those.

6. YOUR RIGHTS AND CHOICES.

You have the following rights, which we honor for all Users regardless of where you live. Because we have Users who reside in California, this Policy is also designed to comply with the California Consumer Privacy Act ("CCPA") and the California Online Privacy Protection Act ("CalOPPA").

a. Right to Know. You have the right to know what PII we collect about you, the purposes for which we use it, and the categories of parties with whom we share it. This Policy describes these; for more information, email privacy@trainyourway.ai or call +1 626-872-4699.

b. Right to Access and Portability. You may request a copy of the PII we hold about you, including Jan's Memories about you, in a portable format.

c. Right to Correct. You can update your profile in the App, and you can ask Jan to correct or forget a Memory. For anything else, email privacy@trainyourway.ai.

d. Right to Delete. You can delete your account and all of your PII yourself with the Delete Account button, as described in Section 5. If you ask us to do it for you, we will, except where we must retain information to comply with a legal obligation.

e. Right to Opt Out of Sale or Sharing. We do not sell PII and do not share it for cross-context behavioral advertising, so there is nothing to opt out of. We nevertheless honor the CCPA requirement to provide a "Do Not Sell or Share My Personal Information" notice: that notice links to this Policy, and you may confirm your preference at privacy@trainyourway.ai.

f. Right to Limit Use of Sensitive PII. Health and fitness information is sensitive PII. We use it only to provide the Services you have requested, as described in Section 3, and do not use it for advertising or inferences unrelated to coaching.

g. Right to Non-Discrimination. We do not treat Users differently for exercising their privacy rights.

h. Communications. To opt out of optional communications, use the unsubscribe link in the message or email support@trainyourway.ai. If you receive text messages from the Services, reply STOP to stop. We may still send you essential messages about your account or security.

i. Location and Health Data. You control location and health-data permissions in your device settings.

j. Do Not Track and Cookies. Our Website responds to browser "Do Not Track" signals. You can control cookies through your browser and opt out of Google Analytics with the browser add-on at https://tools.google.com/dlpage/gaoptout/.

k. California "Shine the Light." Under California Civil Code Sections 1798.83-1798.84, California residents may request a notice identifying the categories of PII shared with third parties for their direct marketing purposes. We do not share PII for that purpose. Requests: privacy@trainyourway.ai.

To exercise any right, email privacy@trainyourway.ai or call +1 626-872-4699. We will verify your identity, typically by confirming control of the email address on your account, and respond within the time required by applicable law. You may designate an authorized agent to make a request on your behalf.

7. CHILDREN.

The Services are intended for adults. You must be at least eighteen years of age to create an account. We do not knowingly collect PII from anyone under eighteen, and we comply with the Children's Online Privacy Protection Act ("COPPA") with respect to children under thirteen. If we learn that we have collected PII from a person under eighteen, we will delete it. If you believe a minor has provided PII to us, email privacy@trainyourway.ai.

8. USERS OUTSIDE THE UNITED STATES.

TrainYourWay operates the Services from the United States. If you access the Services from the European Union, the United Kingdom, Canada, Australia, or another jurisdiction with data-protection laws, you understand that your PII will be transferred to and processed in the United States in accordance with this Policy. Where such laws apply, our legal bases for processing are performance of our contract with you and your Gym, your consent (for health data and Memories, which you may withdraw at any time by revoking permissions or deleting your account), and our legitimate interests in securing and improving the Services. You may have the right to lodge a complaint with your local data-protection authority.

9. SECURITY.

We use commercially reasonable administrative, technical, and physical safeguards consistent with industry standards, including encryption in transit and at rest, role-based access controls, audit logging of access to member data, and pseudonymous storage of Memories. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your credentials confidential and for securing your device. If we learn of a security incident affecting your PII, we will notify you as required by law.

10. EXPERIMENTAL FEATURES.

Some features of the Services are experimental, in beta, or in limited release. They are labeled as such in the App or described to you before you use them. Experimental features may collect additional information described at the time you enable them, may be available only for a limited time, and may be changed or withdrawn. Where an experimental feature involves a new category of PII or a new use, we will ask for your separate acknowledgment before enabling it.

11. CHANGES TO THIS POLICY.

We may revise this Privacy Policy from time to time. If we make a material change, we will notify you in the App and, where required, ask you to review and accept the revised Policy before you continue using the Services. We will always update the "Updated" date at the top of this Policy. Your continued use of the Services after a revised Policy takes effect means you accept it.

12. THIRD-PARTY SITES AND SERVICES.

This Policy applies only to information we collect through the Services. The Services may link to or interoperate with websites and services not operated by us, including Apple Health, Health Connect, and the app stores. This Policy does not apply to them, and we encourage you to review their privacy policies.
